New Recommended Forms for Chapter 13 Cases Pending in the U.S. Bankruptcy Court for the Western District of Virginia

Effective today December 1, 2017, in all chapter 13 cases filed on or after today, Official Form 113 (the national form plan) is required for use. A copy is available on the Courts website under Forms. In addition, the U.S. Bankruptcy Court for the Western District of Virginia has prepared two new forms which  are recommended for use in chapter 13 cases, effective December 1, 2017.

One recommended form is a Certification of Mailing and/or Service of Chapter 13 Plan. The debtor is responsible for service of all chapter 13 plans and must certify to the Court how service has been made. Please review amendments to the Federal Rules of Bankruptcy Procedure 3012(b), 3015(d), and 4003(d), which become effective December 1, 2017.

The second recommended form is an Amended Chapter 13 Plan Cover Sheet and Notice of Hearing.

Although not required, the Court strongly encourages the use of the certificate of service and the cover sheet  in conjunction with use of Official Form 113.
